Friends of Vacaville, California, September 26, 2007 – The Friends of Lagoon Valley steering committee decided last night to ask attorney Stuart M. Flashman to petition the California Supreme Court for review of the lawsuit against the City of Vacaville and Seattle-based Triad Communities seeking to halt a planned subdivision development in Lagoon Valley, an 862-acre parcel on the south side of Interstate 80 between Fairfield and Vacaville in Solano County. In defiance of a successful 2004 referendum petition by the Friends of Lagoon Valley, the City approved Triad’s plans to build over 1000 homes, a golf course and a business village in the semi-rural Valley. The Supreme Court petition addresses what we believe to be a misapplication of the State’s Density Bonus law in favor of the developer. In November 2005 Visiting Judge Donald R. Fretz found against the Friends of Lagoon Valley on both counts and last month the California First District Court of Appeals affirmed that judgment. development that members believe will contribute to increased
flooding along Alamo Creek in Friends of Lagoon Valley steering committee members have also committed themselves to focus renewed energies and attention on the Army Corps of Engineers permitting process, the U.S. Fish & Wildlife Service review, the Regional Water Quality Control Board review and other environmental issues related to the proposed project.
