Friends of Lagoon Valley to Sue

Vacaville , California , March 17, 2005 -- Oakland attorney Stuart M. Flashman today notified the Vacaville City Council and Triad Communities that Friends of Lagoon Valley (FLV) intends to sue concerning currently planned development in Lagoon Valley , an 862-acre parcel on the south side of Interstate 80 between Fairfield and Vacaville in Solano County .

 The lawsuit hinges on two issues: (1) Vacaville City Council's inconsistency in approvals between the General Plan and the 1991 Policy Plan, and (2) misapplication of the Urban Density Bonus favoring the developer.

 In February the City approved Triad’s plans to build over 1000 homes, a golf course and a business village in the Valley.  Friends of Lagoon Valley believe that most residents of Vacaville oppose subdivision development in the Valley and would say so resoundingly if given a chance.

 The lawsuit represents FLV's latest effort to prevent a development that members believe will contribute to more traffic snarls on I-80 and create irreversible urban sprawl because the Valley is completely disconnected from the City of Vacaville .

 With the lawsuit, Friends of Lagoon Valley calls attention once more to the developer-driven process of the Vacaville City Council which ignored the wishes of over 6,000 registered voters in the City of Vacaville who asked for a vote on this issue.

 An extension of the Suisun Marsh and San Francisco Bay , Lagoon Valley is a unique watershed which impacts four creeks in the immediate area. Lagoon Valley is "a treasure trove of archaeological and historic resources, the gateway to our lovely city and a buffer from surrounding sprawl," said Elissa DeCaro, a member of Friends of Lagoon Valley.

 FLV Spokesperson Marian Conning adds, " Lagoon Valley is the last natural open valley between San Jose and the Sierra on I-80 and deserves the highest and best use, not the usual addition of subdivision sprawl."
